Welcome to the Body Insights App ("App"). This document is our Terms and Conditions ("Terms"), which you must agree to in order to use our App.
1. Acceptance of Terms
By downloading and using the App, you agree to be bound by these Terms. If you do not agree with these Terms, please do not download or use the App.
2. No Personal Data Collection
Our App is currently designed to operate without collecting or processing personal data from users. The App operates without user login, providing a "no strings attached" experience.
3. Age Restrictions
The App is not intended for use by persons under the age of 13. By agreeing to these Terms, you represent and warrant that you are at least 13 years old.
4. Use of the App
You agree to use the App in compliance with all applicable laws and not for any unlawful purpose. Any misuse of the App will result in termination of your access to the App.
5. Intellectual Property Rights
All content of the App, including but not limited to the name "Fitness Punks", the App design, and the algorithms behind our personalized fitness recommendation, are protected by copyright, trademark, and other intellectual property laws. Unauthorized use of the App's content is prohibited.
6. Changes to Terms
We reserve the right to change these Terms at any time. If we make changes, we will notify users via the App, and your continued use of the App after the changes have been posted will constitute your acceptance of the changes.
7. Governing Law
These Terms and your use of the App are governed by the laws of Lithuania. Any disputes will be resolved in court of Lithuania.
8. User Conduct
Users of the App agree not to engage in activities that may infringe on the rights of others, including but not limited to, harassment, violation of privacy, or infringement of intellectual property rights. Users found violating this policy may have their access to the App terminated.
9. Disclaimer of Warranties and Limitation of Liability
The App is provided on an "as is" and "as available" basis. Body Insights disclaims all warranties, express or implied, including but not limited to fitness for a particular purpose or non-infringement. Body Insights does not warrant that the use of the App will be uninterrupted or error-free. In no event shall Body Insights be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or related to your use of the App.
10. Termination
Body Insights reserves the right to suspend or terminate your access to the App at any time for operational, regulatory, legal, or other reasons.
11. User Feedback
If you provide Body Insights with any feedback or suggestions regarding the App ("Feedback"), you hereby assign to Body Insights all rights in the Feedback and agree that Body Insights shall have the right to use such Feedback and related information in any manner it deems appropriate. Body Insights will treat any Feedback you provide as non-confidential and non-proprietary.
12. Updates and Changes to the App
Body Insights reserves the right to modify, suspend, or discontinue the App or any part of it, at any time and without notice to you, and it will not be liable to you should it exercise such rights.
13. App Availability
The availability of the App may be interrupted, including for maintenance, upgrades, system or network failures, or other reasons. Body Insights shall not be liable for any such interruptions.
